2. The truck will be fabricated as per design set by M/s Bubblebath Mobile Car Spa. It is expected from the franchise that he/she will not change the set-up/ design without due approval from company as a lot of time, money and efforts have been already put in to ensure consistent outcomes for the given service.
3. The franchise hereby agrees that the consumables required for entire operations will be supplied by M/s Bubblebath Mobile Car Spa Pvt Ltd at discounted rates and it will be binding on the franchise to use the same till the time he is holding the franchise with M/s Bubblebath Mobile Car Spa Pvt Ltd.
4. Franchise will give an undertaking mentioning that the SOPs set in by the company will be followed meticulously, failing which the franchise-ship will be suspended /terminated as deemed fit.
5. The proprietor will pay one time royalty of Rs 2,50,000/- out of which first 50,000/- will be non-refundable booking amount to be submitted along with Expression of interest. Once the booking amount is paid the area covering desired pin-code will be reserved for that proprietor. Another 50,000/- will have to be paid at the time of commencing of training. Once the vehicle is registered, fabricated and franchise completes the training the allotted account will be made active upon payment of rest Rs. 1,50,000/-. The subscription for first 6 months will be paid in advance thereafter it will be paid within first 5 days of each month. Upon completion of 2 years of contract Rs 25,000/- will be refunded to the franchise but if the franchise decides to part away from M/s Bubblebath Mobile Car Spa Pvt Ltd before the agreed upon period of 2 years from entering in to agreement the franchise will have no right to claim refund of 25,000/- at the end of two years.
6. Royalty and subscription mentioned in para 5 will be applicable to first 50 franchise for two years. For franchise entering in to business thereafter, M/s Bubblebath reserves the rights to revise/amend costs as decided by Board of the M/s Bubblebath Mobile Car Spa Pvt Ltd. The above mentioned ‘Early Bird’ advantage is limited to first 50 (Fifty) franchise.
7. In return to the above amount M/s Bubblebath will give the following services to the franchise.
(a) Will provide fabricated unit to franchise at his given address which can be assembled at franchise location at his/her cost.
(b) Will advertise for Bubblebath Mobile Car Spa Centrally to benefit all clients (social media/Print Media/Radio/TV etc)
(c) Will impart training to the Driver-cleaner duo so that they are acquire necessary skill set. Training will be carried out at suitable designated training unit. The franchise needs to cater for stay and catering on their own.
(d) The App will be functional at all times (except unexpected break-downs). The app service is subscription based. No commission will be charged to any order once monthly subscription is paid.
(e) It will be ensured by M/s Bubblebath Mobile Car Spa Pvt Ltd that no pin-code will be allotted to more than one franchise truck so that there is no internal competition between franchise partners. All app services including booking, online payment, rating & reviews, Google Map and Loconav, OTP, notification services will be made available to the franchise at no extra cost other than subscription amount.
8. The franchise should give undertaking that the consumables like Polishing pads, microfiber towels will be used for desired period as advised in Bubblebath Mobile Car Spa manual as underuse will lead to wastage and overuse will affect quality of job adversely.
9. The responsibility of handling all mandatory compliances for manpower hired by franchise will remain that of the franchise. Under no circumstances M/s Bubblebath Mobile Car Spa will be held responsible for ensuring compliance with such norms (as amended time to time) except for those directly employed by M/s Bubblebath Mobile Car Spa Pvt Ltd.
10. Under no circumstances, M/s Bubblebath Mobile Car Spa Pvt Ltd will be held legally responsible for any illegal activity done by franchise, cleaner-driver partners. We hereby indemnify ourselves from any such activity not related to professional work generated through the app or not in accordance with the company SOP. It will be sole responsibility of the franchise and/or the driver-cleaner partner.
11. M/s Bubblebath Mobile Car Spa Pvt Ltd is primarily responsible for brand creation, connecting customers to the service provider, logistic and training support to our franchise however maintaining the desired professional standards is sole responsibility of the Franchise/ driver-cleaner partners. Any dispute arising between the customer and the service provider as a result of execution of the job will be resolved by the customer and the franchise amicably or by using legal remedies available to them as per law of the land. M/s Bubblebath Mobile Car Spa, its directors, its direct employees are hereby indemnified from any such legal action.
12. The franchise /Driver cleaner partner should ensure that the vehicles are always in roadworthy condition. Insurance, PUC, Registration Certificate of the vehicle must always be kept up to date and available to authorities to inspect. Insurance must cover third party liabilities too.
13. Driver partners should have valid driving licence (Commercial). He should observe traffic rules meticulously. Traffic rules violation will be his sole responsibility and all financial implications for the same are to be borne by the driver/ franchise themselves. M/s Bubblebath mobile Car Spa Pvt Ltd will not be responsible in whatsoever manner for any such lapses.
14. Franchise, Drivers/Cleaner partners should not have criminal record. Police clearance is must before any franchise or Driver-Cleaner partner is appointed. As our services are being offered at doorstep of the customer (including driving the franchise vehicle enroute) it should be ensured that the Driver/Cleaner partners are not addicted to abusive substances. They shouldn’t be having any medical history of mental illnesses which can pose danger to our clients even remotely.
15. Arrangement of soft water locally will remain responsibility of the franchise. As the hard water is detrimental to paint quality as well as it leaves hard water marks. It is advised that, hard water should never be used for the purpose of Car Wash.
16. Driver-cleaner partners will be given an opportunity to undergo adequate training at designated training centres. They are expected to learn actively to attain the desired standards for the given set of skills. They should always ensure that all the steps to carry out any given task are being followed meticulously. If the driver-cleaner partner is found to be lacking on the same the contract between the franchise and Ms Bubblebath Mobile Car Spa Pvt Ltd will be terminated unilaterally without leaving any right for franchise to claim refund of Royalty or subscription fees. M/s Bubblebath Mobile Car Spa Pvt Ltd wants to ensure high quality service to its esteemed clientele every time.
17. The water saving methods, (using atomiser spray nozzle) devised by the company is the main USP. Save water, Save Earth is our motto so, it will be ensured that indiscriminate water usage is avoided at all times. All connections, pipelines, water tank are well maintained and should be free from leakage.
18. The driver-cleaner partner should execute services wearing his Service T-Shirt, Cap, Mask etc. Use of nitrile gloves is strongly recommended to avoid contamination of hands and various touch points of the car.
19. A GPS tracking device will be installed in the franchise’s car wash van to enable the app to track the van and the order areas. Under no circumstances the franchise, Driver-Cleaner partner will tamper with the device. This device will be under warranty and on-site service back-up for a period of one year. Any malfunctioning with device needs to be brought in to notice of Bubblebath Mobile Car Spa immediately for corrective action at our end.
20. Only trained cleaners will carry out assigned job. Franchise will not allow any other untrained personnel to attend the order. There are established processes to have thorough background check for cleaner partners including Police Clearance. The client is also intimated about the cleaner beforehand so that the client is handing over keys to correct person is ensured.
21. Franchise will be solely responsible for requisite licences, consents, approvals of Govt authorities as mandated by local governing bodies to operate Bubblebath Mobile Car Spa in the assigned service zone. The cost incurred for obtaining such licences/approvals will be borne by the franchise themselves. Administration of Bubblebath Mobile Car Spa Pvt Ltd will extend its expertise to guide our franchise to smoothen the process however, the client will be primarily responsible for obtaining such permissions.
22. Franchise shall operate the point of service in compliance with standards, procedures, policies methods, specification and requirements as instructed during training and as mentioned in the Bubblebath Mobile Car Spa Manual.
23. Franchise will have to provide a prescribed vehicle duly registered on Franchise name. Such vehicle will be installed with our innovative prefabricated set up. Bubblebath Mobile Car Spa will provide a functional start-up kit and training to cleaner partners (Manual included) at no extra cost to the customer.
24. Bubblebath Mobile Car Spa Pvt Ltd has devised a very practical training programme for process standardisation. The cleaner partners will undergo mandatory training before starting accepting orders on the Bubblebath App. This training will be carried out at premium car care studio Turtle Wax Car Care Studio – RoughTaar Pune. The professional charges for training the cleaner partners are covered in the Royalty itself. However, stay and living expenses will have to be catered separately by the franchise. Bubblebath Mobile Car Spa will impart ongoing training by holding conferences, training events (In-person/Virtual) to keep pace with changing technologies/market scenarios. The duration, content and cost (if any) will be at the discretion of Bubblebath Mobile Car Spa Pvt Ltd.
25. Bubblebath Mobile Car Spa has meticulously curated packages and prices for each package. Bubblebath Mobile Car Spa will have sole rights to decide, change, revise the packages and prices. It will be binding on the franchise to abide by the same. The promotional offers will be rolled out by Bubblebath Mobile Car Spa Pvt Ltd. These offers will be available online only. No franchise will offer lower prices or additional services on their own. The promotional discounts /coupons granted by Bubblebath Mobile Car Spa are intended to increase the market share by the franchise. No reimbursement for the discounted price will be admissible.
26. Bubblebath Mobile Car Spa reserves the rights for testing, Sampling, analysis, inspection and/or sampling of goods or services being used by franchise.
27. Bubblebath Mobile Car Spa shall have no obligation to obtain/maintain any insurance for or on behalf of franchise. Maintenance of the vehicle, fitments, equipment, accident claims will be sole responsibility of the franchise.
28. All systems of operations, policies, standards, techniques, training material, methods of advertising and promotion, public relation materials are confidential trade secrets and franchise will not disclose these trade secrets to any other third party.
29. Bubblebath Mobile Car Spa will be responsible for maintaining software platform, making logistics and training arrangements, designing and optimising the set up for car wash van, providing initial start-up key, providing support for B2B opportunities, providing training for cleaner partners through our training partners for the duration of the contract period. However, by no means Bubblebath Mobile Car Spa can give assurance or guarantee any particular number of orders or business or particular amount as possible net/gross profit. Creating a sustainable business opportunity will be our endeavour but utilising this opportunity to its best possible extent will be dependent on various factors beyond our control.
30. Franchise can’t transfer or sub-lease the agreement to any third party under any circumstances.
31. Royalty needs to be paid against any pin code only once. After the contractual period is over the franchise will have first claim over that particular area. Nominal contract renewal fees will have to be paid at the time of renewal (as decided by Bubblebath Mobile Car Spa Pvt Ltd time to time). If a franchise decides to discontinue service in that area the at the end of contractual period, then only that area will be made available to any other interested party.

PART B – TERMS APPLICABLE TO CUSTOMERS
Part B of these Terms of Use sets out certain terms and conditions which are applicable to any person registering as a customer and using the Services of ‘BubblebathTM’
1. Registering as a Customer
(a) In order to benefit from all the features of the Services available you will need to Sign-Up/Register with us by filling the Sign-Up form. You will be asked to provide certain information about yourself including your name, contact details and vehicle information. You must ensure that the information provided by you is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you have provided, by updating your details, so we can communicate with you effectively.
(b) By using this website and on procuring quotations therein, you hereby authorize us to contact you via calls, emails, and/or text messages on the contact details so provided, to furnish you with information with regards to the services and products of ‘Bubblebath Mobile Car Spa Pvt Ltd. This authorization shall be licit for the mentioned purposes irrespective of whether you are registered with the NDNC registry.
2. Provision of Services to Customers
(a) Following Sign-Up, we will make certain services available to you free-of-charge. The services will include the ability to search Cleaners / Service providers for car wash and detailing work, ability to view detailed profile of Cleaners / Service providers and their services prices and ratings information and the ability to post feedback and ratings in relation to any Cleaner / Service provider you have used as a result of your use of the platform. We reserve the right to add, change or remove services from our platform at any time, and may make certain services chargeable at our discretion.
(b) You must only book a service if you have a genuine requirement for the work detailed to be performed. You must only post Feedback in relation to a Service Provider if you have used them as a result of your use of the BubblebathTM App.
(c) We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the service without notice.
3. Provision of Payment Platforms to Customers
(a) Some services made available for booking to you include the opportunity to make payments facilitated through our service. Such payments will be made using trusted third party payment gateways.
(b) By making a payment through ‘BubblebathTM’ app, you undertake that the credit or debit card details, or third party wallet login credentials that you provide are for your own credit or debit card, or wallet account, and that you have sufficient funds to make the payment for the services booked.
(c) We reserve the right to alter prices or services or cease to list services at any time, without prior notice or warning.
(d) The total price shown for services is inclusive of the items described for that service and may not include additional services found to be required at the time of availing your service. In such a case if you choose to avail an additional service a separate invoice for the Add-on services will be generated.
(e) Cash on delivery (COD) is not available as an option, full payment must be made for through a payment option offered to you before services are provided to you.
(f) In cases where a form of online payment is offered and selected you must complete the payment in full to successfully make the booking. Payment details provided are not stored by BubblebathTM and are encrypted by the payment provider selected to ensure security.
4.Cancellation and rescheduling Policy-
(a) If a client decides to reschedule his/her appointment before 24 hrs prior to time of execution, the company will honour the clients wish without any extra charges or penalty. The client will have to select available slots in that week (next 7 days) if no slots are available the client will be refunded 100% of the booking amount for that particular visit/order. If rescheduling is done within less than 24 hrs from the scheduled time, the client will have to pay Rs. 50/- as rescheduling charges. Cancellation of booking within less than 24 hrs from execution of the order will attract deduction of 50% of booking amount. Cancellation of the scheduled order before 24 hrs prior to execution will be free of charge. The amount of refund will be calculated by our system and same will be credited to customer’s account from which payment was received within 5-7 working days as per refund policies of our digital transaction partner ie Razorpay Software Pvt Ltd.
4. Our Responsibilities to you
We will provide Bubblebath Mobile Car Spa Services to you using reasonable skill and care and in accordance with the cleaning/detailing protocols set by the company. The protocols are set using inputs from the experts in the car wash/car spa industry and the practices may keep improving with better products, cleaning techniques. We will try our best to offer a standardised service product to you at that point of time through our cleaners/franchise.
PART C – TERMS APPLICABLE TO FRANCHISE/CLEANER (SERVICE PROVIDERS)
Part C of these Terms of Use set out certain terms and conditions which are applicable to any person or business registering as a “FRANCHISE/CLEANER” on our Website/App
1. Registering as FRANCHISE/CLEANER (Service Provider)
In order to benefit from all the features of BubblebathTM available to you will need to register with us. You will be asked to provide certain information about your business including but not limited to your commercial vehicle details, business details, Address and contact details, working hours, location details, Police Verification etc. You must ensure that the information provided by you on registration is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you provide, by updating your details, in order that we may communicate with you effectively.
2. Provision of the Services to Dealer Partner
Following registration, we will make certain services available to you. The services will include the ability to include details of your business on our platform, the ability to view or receive details of Customer Service bookings which have been posted by Customers and the ability to accept bookings and share service status updates with Customers. Full details of the services available to Partners on our platform will be published on our Website/App from time to time. We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the service without notice.
3. Our Responsibilities to you
We will provide BubblebathTM Services to you using reasonable skill and care and in accordance with these Terms of Use. However, if you use The Services as a franchise/Cleaning partner, you acknowledge and agree that the services, we provide are subject to the following limitations and disclaimers:
(a) You acknowledge and agree that we will enable Dealers to register and get listed based on criteria which we (in our absolute discretion) may determine from time to time. In addition, you acknowledge that the number of Service bookings which may be posted or transmitted to a franchise/Cleaner in relation to any particular customer may be limited in number. Accordingly, we do not provide any guarantee that registering as a franchise/Cleaner will result in you being invited to receive any particular volume of Service bookings. Nor can we guarantee that your use of BubblebathTM will result in you winning any work or any particular volumes or work.
(b) You acknowledge and agree that we do not check or verify the details of any Service Bookings which are posted. We have asked all users to use ‘BubblebathTM’ responsibly but cannot guarantee the accuracy, integrity or quality of any information which is posted by third parties.
(c) By registering as a franchise/Cleaner Partner you also understand and agree that Customers who have used your services will be able to provide Feedback and Ratings. Whilst we have asked all users to act responsibly, we do not actively monitor, check or verify Feedback which is posted. Accordingly, you acknowledge and agree that we (Bubblebath Mobile Car Spa Pvt Ltd) shall not have any responsibility to you or liability to you for any Feedback which is posted by any Customer and we will not usually become involved or intervene in complaints or disputes concerning Feedback, although we reserve the right to do so in exceptional circumstances. You may, if you feel that Feedback is misleading or incorrect, contact us and we will investigate but we shall not be obligated to take any action.
4. Your Responsibilities
(a) You agree to abide by the Terms of Use when using BubblebathTM which we make available via online media such as website, mobile apps and SMS.
(b) You shall be solely responsible for checking and verifying the details of any service booking which is posted before you agree to undertake any work for a Customer and for agreeing with the Customer the terms and prices of services on which any work will be performed.
(c) You shall be responsible for complying with all applicable laws and regulations in your dealings with Customers and for the performance and quality of any work which you agree to undertake for any Customer.
PLEASE NOTE: By registering as a Franchise/Cleaner Partner and by using BubblebathTM you are agreeing to indemnify us and hold us harmless from any costs, losses or claims which may result from any information you submit or transmit via BubblebathTM or from any work which you agree to perform for any Customer.
PART D – GENERAL TERMS APPLICABLE TO ALL USERS
Part D of these Terms of Use set out certain terms and conditions which are applicable to all users of this platform including Customers and Franchise or cleaning Partners.
1. Passwords and Security
(a) If you register to use BubblebathTM Services you will be given a username and password. You must keep your ID confidential and must not disclose it or share it with anyone. You are responsible for preventing unauthorised use of your ID.
(b) If you believe there has been a breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately. If we reasonably believe that your ID is being used in any way which is not permitted by these Terms of Use, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issues has been resolved.
2. Acceptable Use Policy
(a) The Services allow registered users to create, edit and submit material for inclusion on or transmission via BubblebathTM, including (without limitation) by creating Cleaner’s profile, posting service bookings, responding and updating status of bookings and posting ratings feedback for automotive services. Whilst we do not seek to monitor or control the submission of information, we do reserve the right to delete, move and edit any Material submitted where (in our absolute discretion) we consider it prudent or necessary to do so.
(b) You agree to comply with all applicable laws and regulations when using BubblebathTM. You are solely responsible for all Material you submit for inclusion on or transmission via BubblebathTM. You must ensure that all Material you transmit is lawful and honest. In particular you must not post or transmit any Material that:
(i) is fraudulent, dishonest or misleading;
(ii) is unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable or breaches any laws;
encourages conduct that constitutes a criminal offence, gives rise to civil liability or otherwise breaches any applicable laws, regulations or code of practice;
infringes the copyright or other rights of any third party;
is technically harmful (including, without limitation, computer viruses or other malicious software or harmful data).
(iii) By submitting Material to us you are granting us a royalty-free, non-exclusive licence to use, reproduce, modify, translate, make available and distribute the Material on or through BubblebathTM for the purpose of operating services.
(c) By registering with ‘BubblebathTM’ you authorise Bubblebath Mobile Car Spa Pvt Ltd to install and use tracking devices in your service vehicles. It will result in complete tracking of all your movements by the service vehicle. And, as a franchise/cleaner you will not tamper with the tracking device.
(d) By registering with BubblebathTM you as a franchise/ Cleaner agree to abide by the service/cleaning protocols, recommended products/ brands of the products. Also, the cost/charges set by company are binding and you will restrict your commercial activities of Mobile Car Wash Business within the allotted area.
3. Disclaimers
Although we aim to offer you the best service possible, we make no promise that Services will meet your requirements. We cannot guarantee that Services will be fault free or continuously available. Your access to BubblebathTM may occasionally be restricted to allow for repairs, maintenance or the introduction of new features.
4. Liability
(a) To the fullest extent permitted by law, we exclude all liability to you for any loss of profit, loss of opportunity, loss of earnings, loss of anticipated earnings or loss of data or for any indirect or consequential losses howsoever arising out of your use of BubblebathTM or any fault or problem relating to or any content received via BubblebathTM.
(b) Nothing in these terms of use shall exclude or limit our liability for death or personal injury due to our negligence or for fraudulent misrepresentation or for any other liability which cannot be excluded or limited under applicable law. Your statutory rights as a consumer are not affected by these Terms and Conditions.
5. Termination of Services
(a) We may suspend or cancel your registration and/ or terminate your access to BubblebathTM if you are in breach of these Terms of Use or have made improper use of The Services. You may cancel your registration at any time by informing us in writing. If you do so you must stop using The Services.
(b) The suspension, cancellation or termination of your registration and your right to use The Services shall not affect either party’s statutory right or liabilities.
6. Intellectual Property
Unless otherwise stated, the copyright, database right and other intellectual property rights in BubblebathTM (including without limitation all content, materials and technology used or appearing or transmitted through it) belongs to us or our licensors. All rights are reserved.
7. Privacy and Cookies
The BubblebathTM platform includes areas where you are requested to input information about yourself. Any information you submit to us shall be subject to the terms of our Privacy Policy. We use cookies on our website. By registering use, you are consenting to our use of cookies
8. General
All notices shall be given to us via email or by post using the contact details set out in the Contact Us section, or to you at either the email or postal address you provide during registration.
We may revise these Terms of Use at any time. You are expected to check these Terms of Use from time to time to take notice of any changes we make as they are legally binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our website.
9. Applicable Law
These Terms and Conditions will be subject to the laws of Union of India and the courts in ‘Mumbai’, Maharashtra shall have jurisdiction to resolve any disputes between us.
